The driver must be over 28 years old and must present a valid Class B driving licence with a minimum of 4 years’ experience.

Persons who are not residents within the EU must hold a valid international driving permit.

Only two persons approved by the rental company and duly identified in the contract in the “authorized drivers” section will be allowed to drive the motorhome.

At any time, including during the rental period, an authorized driver can be added for a cost of €35.

Under no circumstances will permits, licences, driving licences or any type of documentation that is not valid or has expired be accepted.

The vehicle is covered by comprehensive insurance with an excess of €750, which does not include the personal belongings of the renter and passengers. In the event of an accident or theft, the renter will be responsible for €750 per claim.

The €750 deposit paid by the renter will be used to cover costs in the event of a claim or any other incident requiring the insurer to apply the insurance excess. It will also cover possible penalties detailed in this document (returning the vehicle uncleaned, speeding fines, loss of keys, interior damage to the vehicle, etc.). If the deposit is not sufficient to cover the excess, penalties, or other interior damages, the renter agrees to pay the difference within a maximum of 48 hours from the date of vehicle return or the end of the contract period.

The vehicle as a whole shall be used for the normal use of a motorhome.

In no case may it be used for participation in events, gatherings, or illegal acts, or acts that violate morality, public decency, or the law.

It is not allowed to transport more passengers than those permitted by the vehicle’s homologation and registration certificate.

The motorhome may not be re-rented, sublet, or transferred for any paid or commercial use.

It is not permitted to transport goods, participate in races, push or tow other vehicles or trailers, carry out modifications to the electrical system, or tamper with the odometer (any anomaly must be reported immediately to the rental company). It is also not allowed to alter any technical characteristics of the vehicle such as keys, locks, equipment, tools or accessories, nor to modify its original appearance, either interior or exterior.

Driving outside the European Economic Area will require the express authorization of the rental company, as will driving in any country or region involved in an armed conflict or war.

The renter shall be responsible for any fines or penalties, as well as judicial and extrajudicial costs arising from any traffic offence or any other type of infringement attributed to the vehicle, the renter or the rental company, resulting from the use and circulation during the rental period and the duration of the contract, unless they were caused by the rental company.

The vehicle is equipped with a GPS tracker with speed monitoring. If 130 km/h is exceeded, a penalty of €50 will be applied (each time this limit is exceeded), regardless of any traffic fines, which will be deducted from the deposit.

The renter shall also be responsible for all additional costs in the event that, due to misuse of the vehicle, it is detained or seized, including the rental company’s loss of income during the period the vehicle is immobilised, as well as any expenses incurred by the rental company (including lawyers’ and legal representatives’ fees) in recovering amounts owed by the renter under this contract.

The renter shall be civilly and subsidiarily liable in the event of an accident, claim or incident that is not reported immediately after it occurs to the rental company, the insurance company, or the relevant authorities when required.

Fuel costs are the responsibility of the renter.

Pets are not allowed in the motorhomes. For hygiene reasons and to prevent the spread of allergies, bringing animals into the motorhome is strictly prohibited. If any animal is found to have entered the motorhome, a penalty of €200 will be applied.

Roadside assistance coverage does not apply if the vehicle is stuck or involved in an accident خارج authorised roads. Therefore, driving on unpaved or non-regulated roads is prohibited, except in designated areas within campsites, service areas or parking areas.

Failure by the renter to comply with the above condition/clause will mean that, if the vehicle needs to be recovered using tow trucks or special equipment, the renter will bear these costs without limitation to the €750 deposit, as such services are usually very expensive.

Smoking inside the motorhome is prohibited. Confirmation that this rule has not been respected will be considered damage and will require the renter to cover additional cleaning and deodorising costs, as well as any compensation costs in case the vehicle cannot be delivered to the next renter.

If the air conditioning or the television stops working during the rental period, no compensation will be provided.

In the event of a breakdown or any other incident, the vehicle must not be left unattended without taking the appropriate measures to protect and secure it. If necessary, contact the roadside assistance company included in the insurance policy. Phone number +34 662 992 060 (ARAG).

If any warning light indicating a malfunction of the vehicle turns on, the vehicle must be stopped as soon as possible and the rental company or the assistance company contracted by the rental company must be contacted, and only with them. The vehicle must be taken exclusively to an official FIAT service centre, unless expressly and formally authorised by the rental company.

Filling the clean water tank with diesel, any type of fuel, or any product other than potable water will result in a surcharge of €650.

In the event of non-compliance with any of these prohibitions, the renter shall bear all costs of restoring and reconditioning the vehicle to its original condition, as well as compensation for the vehicle’s downtime until full repair is completed.

The vehicle will be delivered at the main offices of Caravaning Esguard, at Teulera Street 6, 1746 Santa Cristina d’Aro, on the agreed date and time.

The renter is advised to commit to collecting the vehicle with sufficient time in order to calmly receive the operating instructions required for this process, as well as to be able to attend the on-site inspection of the vehicle and the accessories included in the section “motorhome delivery: condition, inventory of included and optional accessories”.

Together with the vehicle, a complete set of keys, technical data sheet, and vehicle registration certificate will be provided. Loss of the keys will incur a charge of €300 for replacement, and €300 in the event of loss of the documentation, in both cases to be deducted from the deposit.

The vehicle is delivered with a full fuel tank.

The vehicle is delivered with chemical toilet products, in the estimated quantity needed for the duration of the trip.

Maintenance costs, greasing, and engine lubricants are the responsibility of the rental company, as well as normal mechanical wear and tear of the vehicle.

When the duration of the journey so requires, the necessary maintenance operations must be carried out at an official FIAT service centre. In the event of breakdowns, the renter is only authorised to have them carried out with approval at an official FIAT workshop. Tyre damage and/or punctures are always the responsibility of the renter, except in cases of faulty installation or manufacturing defects.

If, due to force majeure, unforeseen circumstances, or reasons beyond the rental company’s control, the vehicle cannot be delivered on the agreed date, this shall not entitle the renter to any compensation, except for the refund by the rental company to the renter of the amount paid as a booking deposit.n.

Failure of the renter to attend on the agreed date, place, and time shall result in unilateral termination of the contract and forfeiture of the reservation by the renter, with a penalty of 100% of the booking amount, and shall also entitle the rental company to dispose of the vehicle specified in this contract. The renter shall have no right to any compensation, refund, or indemnification.

If the renter wishes to extend the rental period, they must request it from the rental company at least 3 days before the end of the contract.

Failure to comply with this condition entitles the rental company to take possession of the vehicle or pursue its recovery through legal action. Likewise, the rental company reserves the right to demand the return of the vehicle at any time during the term of this contract if its use violates the provisions herein.

The renter shall bear all costs arising from abandoning the vehicle in another place or city without the express authorization of the rental company.

In the event of vehicle return at the end of the rental period, where the renter is not present during the inspection due to reasons attributable to them, drop-off via mailbox, or unavailability, and damages are found on the vehicle, the renter accepts the damage assessment resulting from the inspection carried out by the rental company’s staff.

The deposit will be refunded after the vehicle has been inspected by a representative of the rental company, who, in the event of damage due to misuse, will determine the amount to be paid by the customer. This amount will be deducted from the deposit paid, with the renter agreeing to pay any difference if the cost of the damage exceeds the deposit amount. If it is not possible to assess the damage immediately, the rental company will have 30 days to refund, where applicable, the remaining deposit after deducting the cost of repairing any damage caused.

If any damage is detected within 48 hours after the return of the vehicle, during the cleaning or inspection process, the rental company will notify the customer in order to arrange payment for the mentioned damages.

If the renter decides to return the vehicle before the scheduled end date of the contract, they will not be entitled to any kind of refund or financial compensation of any kind.

In the event of breakage or damage to any part of the interior or exterior of the motorhome, the renter is required to inform the rental company within a maximum of 24 hours from when the issue or damage is detected. This allows the rental company more time to obtain the necessary replacement part to repair the vehicle and avoid inconveniencing the next customer.

The rental company delivers the vehicle in perfect condition, having carried out all necessary checks and maintenance for its proper operation. It shall not be responsible for mechanical failures or breakdowns due to normal wear and tear, nor for any costs, delays, or damages of any kind arising directly or indirectly as a result of such failures or breakdowns.

In the event of non-compliance by the renter with any of these measures, where applicable, the rental company may claim from the renter any damages and losses caused by their negligence, including the rental company’s loss of income during the period the vehicle is immobilised.

To confirm a booking, the following payment must be made:

• 30% of the total rental amount upon confirmation of the booking.
• The remaining 70% must be paid 15 days before vehicle collection.

Penalties:

• 50% if cancellation is made 30 days or more before the start of the contract.
• 80% if cancellation is made 15 days or more before the start of the contract.
• 100% if cancellation is made less than 15 days before the start of the contract.

To start the rental, the outstanding rental payment must have been made by cash, card or Bizum 15 days before vehicle collection, as well as a €750 deposit via credit card pre-authorisation at the time of collection.
